Robin Williams was born on 21 July 1951 in Chicago and died on 11 August 2014, aged 63. He won an Academy Award for Good Will Hunting in 1998.

The 25-Year Restriction

Most celebrity estates are built to keep earning. Williams built his to stop.

His trust bequeathed the rights to his name, signature, photograph and likeness to the Windfall Foundation, a charitable entity established by his representatives at the law firm Manatt, Phelps, and restricted their commercial exploitation for 25 years after his death – until August 2039 (The Hollywood Reporter). No authorised advertisement, endorsement, hologram or digital insertion into a new film can use him until then.

Estate lawyers described the provision as something they had not seen before: restrictions on types of use are common, a blanket time bar is not (The Hollywood Reporter).

What That Costs

The financial effect is large and deliberate. Forbes noted that the restriction removes precisely the income stream that makes deceased performers lucrative – the posthumous licensing that puts others on the highest-earning-dead-celebrities lists year after year. Williams chose to forgo it.

His estate plan was otherwise conventional and largely effective, though it did not prevent a dispute between his widow and his children over personal property (CNBC).

Four decades of film and stand-up income, less tax at top California and federal rates and representation; plus California property, including the Napa Valley estate sold after his death; plus continuing residuals. Posthumous licensing is set at zero rather than estimated, because his own trust forbids it until 2039 – the single largest difference between his figure and those of comparable estates. These are broad assumptions rather than accounting: representation costs affect taxable income rather than sitting alongside it, and a headline marginal rate is not an effective rate across a whole career.
